The deadline to submit your bank details has now passed. We are currently conducting verification checks on bank details and other information submitted, including checks required by law, before settlement payments can be made. Some Eligible Group Members may be contacted and asked to provide additional information or documents to help us complete these checks. If we need anything further from you, we will contact you directly. You do not need to do anything unless we contact you. To allow our team to focus on completing this work as efficiently as possible, we are unable to respond to individual enquiries about claim status, compensation calculations or payment timeframes. We note that new registrations cannot be accepted now pursuant to Court order. Missed the deadline? For the Eligible Group Members who missed the deadline , we will open submissions for a further 7-days in or around mid-late November. If you have not submitted your details, we will notify you by your registered contact details when this period opens. The timing of this depends on the progress and outcomes of verification checks, so we cannot guarantee when it will happen. We will post on our website closer to the time. Please do not contact us to ask us about this so we can focus on our work. Once this further deadline passes, there will be no more opportunities to claim your compensation as we must progress the settlement in the interests of all registered group members. When will we be paid? We expect payments to commence in the first quarter of 2027. The change to this expected timeline is in part due to the high volume of new complex claims that have been identified during the bank account collection process. We are also intending to provide a further, final opportunity to group members to provide their bank account details, to ensure that we are able to make payments to as many eligible group members as possible. Once these complex issues are resolved, we will need to undertake mandatory verification checks, to confirm the accuracy and legitimacy of the bank account details provided to us, as well as sanctions checks. Payments can’t commence until all verification checks are complete, and compensation entitlements can be recalculated based on who claims their compensation and passes these checks. For these reasons, we are unable to fast-track individual payments. Payments may be staggered due to the volume of claims being progressed. We are progressing the settlement administration as quickly and efficiently as we can on behalf of all 170,000 eligible group members that are entitled to receive payments.

About This Case

Consolidated group proceeding brought on behalf of persons who purchased “add-on” insurance policies from Allianz Australia Insurance (Allianz) or Allianz Australia Insurance Life (Allianz Life), at around the same time they purchased a car or motorcycle from a motor vehicle dealership, between 1 June 2006 and 27 September 2021 (inclusive).

The claim alleges that by failing to provide potential customers with certain information concerning the “add-on” insurance policies, and in some instances by making representations that purchasing an “add-on” insurance policy was necessary to secure a vehicle, Allianz and Allianz Life engaged in conduct that was misleading or deceptive, that was unconscionable, or by which Allianz and Allianz Life were unjustly enriched. The claim alleges that the group members are either entitled to compensation for losses they have incurred as a result of purchasing the “add-on” insurance policies, or repayment of any premiums paid on those policies.

On 15 September 2021, the Court ordered that this group proceeding be consolidated with a similar class action against Allianz ([name withheld] v Allianz Australia Insurance Limited S ECI 2020 04230). As a result, there are two representative plaintiffs: [name withheld] and [name withheld] (Plaintiffs) in the new single group proceeding.

The proceeding has settled and the proposed settlement has been approved.

Important information about the proposed settlement
