Privacy Policy

How we collect, use, and protect your information.

Effective date: 27 October 2026 — Terms of Use

This Privacy Policy describes how ClaimBar (“we”, “us”, or “our”), a product of Omiga Pty Ltd (ABN 83 660 367 288), operated at claimbar.com, collects, uses, discloses, and manages your personal information. We are an Australian-based business and this policy is written primarily with reference to the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). For people in Canada it also reflects the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada’s Anti-Spam Legislation (CASL). See Section 9.

1. What Information We Collect

We may collect the following categories of personal information:

  • Identity and contact details — your full name, email address, phone number, and state, territory or province of residence.
  • Preferences and eligibility data — category preferences you select (e.g. consumer, data breach, employment), your responses to eligibility questions, and any details you voluntarily provide about your potential claim.
  • Technical data — IP address, browser type and version, device type, operating system, referring URL, pages visited, and timestamps of visits.

We do not intentionally collect sensitive information (such as health, financial account, or government identifier information) unless you explicitly provide it in a free-text field in connection with a specific settlement enquiry.

2. How We Collect Your Information

We collect personal information through the following means:

  • Registration forms — when you register to receive settlement notifications.
  • Case update forms — when you ask to be notified about updates to a specific class action.
  • Data breach check forms — when you submit your email address or name to check whether it appears in a known data breach.
  • Newsletter sign-up — when you subscribe to our email newsletter.
  • Cookies and local storage — we use browser localStorage to remember your country preference. See Section 6 below for more detail.
  • Page counts — we count page views per day without cookies and without storing IP addresses. See Section 6 below.
  • Page feedback — if you answer “Did this page answer your question?” we count the answer, and keep any note you write for 180 days. We ask you not to include personal details in the note.

3. Why We Collect Your Information

We collect and use personal information for the following purposes:

  • Matching you to settlements — to identify class action settlements you may be eligible for based on your state, category preferences, and eligibility responses.
  • Case updates — to email you about deadlines and developments in a class action you asked to follow.
  • Sending notifications — to alert you by email about new settlements, approaching deadlines, or updates relevant to matters you have expressed interest in.
  • Improving our service — to understand how people use the site, diagnose technical issues, and improve the quality and relevance of our content.
  • Legal and compliance purposes — to comply with our obligations under applicable law.

4. Who We Share Your Information With

We may share your personal information with:

  • Law firms — we do not share your details with law firms. If we ever offer an option to be connected with a lawyer, it will be optional, and the receiving firm and any payment to us will be disclosed on the form before you submit.
  • Service providers — we use Cloudflare (hosting, data storage and bot protection) and Resend (email delivery). These providers may store or process your information outside Australia, including in the United States.
  • Service providers — we may use trusted third-party services (e.g. email delivery, hosting) to operate our platform. These providers are only given access to the information necessary to perform their services and are bound by appropriate confidentiality obligations.

5. We Do Not Sell Your Data for Third-Party Marketing

We do not sell, rent, lease, or trade your personal information to third parties for their own independent marketing or advertising purposes.

We do not sell your personal information and we do not share it with law firms.

6. Cookies and Tracking Technologies

We use the following tracking technologies:

  • Page counts — we count page views per day, with the page, the referring website, the country and any campaign tag in the link. We do not use cookies for this and we do not store IP addresses or anything that identifies you.
  • Where you came from — on your first visit we note in your browser’s localStorage which website or campaign link brought you here and which page you landed on. This is sent to us only if you sign up, and is stored with your signup so we know which channels work.
  • localStorage (browser storage) — we store your selected country preference (e.g. “au”) in your browser’s localStorage so that we can remember your preference on future visits. This data is stored locally on your device and is not transmitted to our servers. You can clear it at any time by clearing your browser data.

We do not currently use advertising cookies, cross-site tracking pixels, or third-party marketing cookies.

7. Data Retention

We retain personal information for as long as necessary to fulfil the purposes described in this policy, or as required by law:

  • Registration and notification preferences are retained until you unsubscribe or request deletion.
  • Case-update subscriptions are kept until you unsubscribe or ask us to delete them.
  • Technical/analytics data is retained in aggregated form in accordance with Cloudflare’s data retention policies.

8. Your Privacy Rights

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the right to:

  • Access — request a copy of the personal information we hold about you.
  • Correction — request that we correct any personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading.
  • Deletion — request that we delete or de-identify your personal information, subject to any legal retention obligations.
  • Complaint — lodge a complaint with us in the first instance, and if you are not satisfied with our response, with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

To exercise any of these rights, please contact us at info@claimbar.com. We will respond within 30 days.

9. International Users

ClaimBar is run from Australia. You may use it from other countries. We handle your personal information in accordance with the Australian Privacy Act 1988 (Cth) and, where they apply to you, the privacy laws of your own country.

Your information is stored and processed outside your country: in Australia, and by our service providers Cloudflare and Resend, which may process it in the United States and elsewhere. While it is there it may be accessible to courts, law enforcement and national security authorities of those countries under their laws.

People in Canada

  • Consent — we collect and use your personal information only for the purposes in Section 3, with your consent, which you give when you submit a form. You can withdraw it at any time by unsubscribing or emailing us.
  • Emails — we only email you after you ask us to on a form, and we never pre-tick a consent box. Every email names us, gives our mailing address and email address, and has an unsubscribe link. Unsubscribing takes effect straight away, and in any case within 10 business days.
  • Your rights — you can ask to see the personal information we hold about you, ask us to correct it, or ask us to delete it. We will answer within 30 days.
  • Accountability — our Privacy Officer is responsible for how we handle personal information, and can be reached at info@claimbar.com or at the mailing address in Section 12.
  • Complaints — please contact us first. If you are not satisfied, you can complain to the Office of the Privacy Commissioner of Canada at priv.gc.ca.
  • Names on case pages — case pages describe court proceedings using what the court or law firm has published. We aim not to name individual class members or claimants beyond the formal name of the proceeding. If you are named on a page and want it reviewed, email us and we will look at it promptly.
  • Quebec — ClaimBar does not yet cover class actions in Quebec and the site is in English only.

10. Security

We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification, or disclosure. However, no method of internet transmission or electronic storage is 100% secure, and we cannot guarantee absolute security.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top of this page. We encourage you to review this policy periodically. Your continued use of ClaimBar after changes are posted constitutes your acceptance of the revised policy.
